Description

The project establishes two priority objectives:A) A general study on computer crime. The general aim is to carry out a comparative legal study of the needs for legal supervision in relation to technological crime and the situation of substantive international and supranational criminal law on the subject. The partial objectives necessary for achieving the general objective are the following:1. Identifying national, international and supranational criminal policy.2. Critical evaluation in accordance with the technical/legal criteria of the criminal discipline.3. Dogmatic analysis of the various types of crimes defined in substantive law. B) General study of the responsibility of Internet service providers.The general objective is to carry out a transversal study of the system of responsibility of Internet service providers for the content of users who cross or base themselves in their servers. The partial objectives necessary for achieving the general objective are the following: 1. A factual description of the problem and of primary legal regulation (Civil, Directives, etc.).2. Analysis of the most important illicit behaviour, for which providers should be responsible.3. Limits on the criminal responsibility of individuals and organisations.4. Analysis of the obligations involved with processes and the problems of police investigations into crime.
