The purpose of this specialist course is to learn how international humanitarian law establishes its system of protection by regulating the three elements that come together in war:

 

  • Warring factions, with all the problems that come with this legal status – highlighted in very recent episodes related to the so-called war on terror – and the fact that they participate directly in the hostilities, state and non-state actors, private security companies, mercenaries and an increasingly significant proportion of the civilian population.
  • The weapons and procedures used by these factions, to which international humanitarian law applies the fundamental principle of limitation of methods and prohibits, restricts or conditions – generically and specifically – both known weapons and weapons that could be developed in the future by military technology, including those termed "non-lethal weapons". It also pays special attention to landmines and the protection of the environment in armed conflict.
  • The military targets of the warring parties, which has led to many debates and controversies in recent conflicts due to attacks on dual-use targets or incidental or collateral damage affecting the civilian population and civilian property.

 

This specialist course also takes a detailed look at a topic related to the conduct of hostilities when these have ceased and a system of military occupation exists in the invaded territory. It is of utmost importance to be familiar with this concept and the limits of the authority of the occupying forces over local authorities and local civil servants, the civilian population and civilian property.



The course aims to provide participants with a solid knowledge of international humanitarian law, understood as the series of regulations designed to protect war victims and limit methods of combat. It will also look at the effective mechanisms of the branch of international public law, focusing particularly on the international criminal justice system.
